1Eligibility and Acceptance

The App is intended for individuals legally competent to enter binding contracts under the Indian Contract Act, 1872. By using the App, you represent and warrant that:

• You are at least 18 years of age (or the age of majority under applicable law), or you are using the App under the active supervision and with verifiable consent of a parent or legal guardian who accepts these Terms on your behalf
• You have the legal capacity to form a contract
• All information you provide is accurate, complete, current, and not misleading
• Your use complies with all applicable Indian laws

We reserve the right to verify eligibility and, at our sole discretion, suspend, restrict, or terminate access if any representation is false or these Terms are violated.

2Nature of the Service and Access

The App delivers educational and cultural immersive experiences focused on Indian museums and heritage, including:

• Museum 01 and Museum 02 Menus: Digitally presented handcrafted paintings with clear audio descriptions
• AR Menu (Scan QR & Explore): Point your device at up to 150 designated QR cards to unlock interactive 3D models of artifacts or exhibits
• India Map Menu: 60 distinct 3D animated map videos on geographical, historical, and cultural themes
• Quiz Menu: Topic-based quizzes with three multiple-choice questions per topic

Access to the App is granted exclusively to users who have purchased the physical "Ages of India" product (or qualifying bundle) through authorized channels, including our official websites (caveart.store / agesofindia.com), partner platforms, or retail outlets.

The physical product packaging includes a unique QR code containing an embedded activation token or login credential. Upon installing the App, scan the provided QR code using your device's camera. The App will automatically process the QR code, authenticate the token, and grant full access — enabling seamless, one-time registration and login without manual code entry.

Access is granted for the lifetime of the App or until deactivation by us for valid reasons. We reserve the right to verify purchase authenticity and deactivate access in cases of suspected fraud, tampering, or violation of these Terms.

3Refunds and Cancellations

This Clause governs all purchases of the physical "Ages of India" product. All shipping, returns, replacements, cancellations, and refunds are subject to the terms below and applicable Indian laws, including the Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020.

3.1 Definitions

• "Product" means the physical "Ages of India" packaged item containing the QR code/access token for the App
• "Change of mind" or "non-defective return" means a voluntary return where the Product is not defective, damaged, missing components, or non-conforming
• "Digital access" means the right to use the App features unlocked by scanning the QR code from the Product
• "Working days" means Monday to Saturday, excluding public holidays in Tamil Nadu, India

3.2 Shipping

We ship to all locations within India and select international destinations. International shipments are subject to applicable customs duties, import taxes, clearance fees, and local regulations, all of which are the sole responsibility of the User.

Standard delivery within India is expected within 4–5 working days from dispatch. International delivery timelines vary by destination and will be communicated at checkout. Shipping charges are calculated at checkout based on product weight, destination, and selected delivery mode. Users receive a tracking link via SMS and email upon dispatch. Cash on Delivery (COD) is available across India with no additional charges.

In case of transit-related issues: Delayed delivery: we will communicate the reason and provide an updated estimated delivery date. Lost shipment: full refund processed following courier confirmation of loss. Damaged package: replacement arranged at our expense, provided the User notifies us with clear photographs of the outer packaging and Product within 48 hours of delivery.

3.3 Return & Replacement

Returns for non-defective items (including change of mind) are accepted within five (5) days from the date of delivery, provided the Product is returned in its original, unopened, and unused condition, with all original seals, accessories, packaging materials, documentation, and invoice intact.

The following items are non-returnable:

• Clearance or promotional sale items
• Opened toys or products
• Digital access (once the QR code has been scanned and the App activated, the digital component is deemed consumed and non-returnable/non-refundable)

For defective, damaged, missing, or non-conforming Products, the User is entitled to return, replacement, or refund within 7 days of delivery, even if opened, provided the issue is reported promptly with supporting evidence. Return shipping charges are borne by the User for voluntary returns; for defective or damaged items, return shipping is borne by us, and we will arrange pick-up where feasible.

To initiate a return, submit a request through our website return portal or by emailing caveart.store@caveartstudios.com, including order ID, photographs, and reason for return. We will acknowledge within 48 hours.

3.4 Cancellation & Refund

Orders may be cancelled prior to dispatch at no charge. Cancellation after dispatch is not permitted. No cancellation charges apply for User-initiated cancellations before dispatch. Refunds are processed within 10–15 working days from approval and are issued to the original payment method. COD refunds are processed via bank transfer.

For technical failures (e.g., invalid QR code despite valid purchase) or non-delivery of access within 7 days post-purchase, refund requests may be submitted via our grievance mechanism (Clause 15) within 5 days, with proof of purchase. Approved refunds are processed within 5–10 working days.

4User Account and Credentials

The App provides access through a seamless, one-time registration and activation process using the unique QR code included in your physical "Ages of India" product packaging. No separate username/password is required unless you voluntarily choose to provide additional information for support, personalization, or future account management.

You are solely responsible for:

• Safeguarding the physical QR code and any device on which the App is installed
• Preventing unauthorized access or use of the activated App instance
• All activities that occur under your activated session

You must immediately notify us of any suspected unauthorized access, loss of the physical product, or security breach by contacting our Grievance Officer (details in Clause 15). We reserve the right to suspend or permanently terminate your access in cases of suspected fraud, misuse, unauthorized sharing, or violation of these Terms.

5Digital Content, VR/AR Experiences, and Disclaimers

Content includes simulated recreations (paintings, 3D models, maps, audio, quizzes, VR/AR) for educational and entertainment purposes. Representations may not precisely match real-world artifacts or museums due to technological limits.

You acknowledge and accept these XR-Related Risks and agree to use the App responsibly: take regular breaks, use in a safe, spacious, seated or supervised environment free of hazards, ensure device compatibility, and immediately stop use if any discomfort arises. Parents/guardians supervising minors assume full responsibility for monitoring and limiting session duration.

We are not liable for any XR-Related Risks, physical injury, discomfort, psychological effects, device issues, aggravated conditions, or related losses, except to the extent caused by our gross negligence or willful misconduct or as required by non-excludable provisions of Indian law.

6Intellectual Property Rights

All rights in the App and Content (software, code, VR/AR environments, 3D models, paintings (digital), audio, videos, quizzes, graphics, trademarks, logos) are owned by or licensed to us, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Designs Act, 2000, and other applicable laws.

We grant a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial, educational use during authorized access. You shall not (nor permit others to): copy, reproduce, modify, distribute, transmit, display, perform, create derivatives, reverse engineer, remove notices, share/record/screenshot content including for AI training, social media, or commercial use, or exploit commercially without prior written consent. Unauthorized use is infringement and may result in termination and legal action. All rights reserved.

7User Conduct and Prohibited Activities

Use the App lawfully and responsibly, complying with applicable laws including the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Prohibited Activities include:

• Harassment, hate speech or discrimination (based on caste, religion, gender, etc.), distributing malware, impersonation, spreading false information, illegal promotion, commercial exploitation, unauthorized access or hacking, or recording/sharing content
• Misuse, misrepresentation, or disrespectful treatment of cultural, historical, or heritage content, including any act that offends cultural sensitivities, distorts Indian heritage, or violates the dignity of cultural artifacts, monuments, or communities represented in the App

If such prohibited activities are undertaken, we reserve the right to suspend or terminate access to our services and to cooperate with or report the matter to appropriate law enforcement authorities, as required under applicable law.

8Third-Party Services and Integrations

The App may be compatible with certain third-party VR headsets, viewers, or XR hardware (e.g., Meta Quest, other standalone or tethered headsets) to enhance immersive experiences. We do not manufacture, sell, supply, endorse, or provide any such third-party hardware.

You are solely responsible for obtaining, maintaining, and ensuring the safety, compatibility, and proper functioning of any third-party VR/XR hardware used with the App; complying with the manufacturer's instructions, safety guidelines, and warranties; and any risks, damages, injuries, or issues arising from the use of third-party hardware.

We disclaim all liability for any loss, damage, injury, or claim related to third-party VR/XR hardware, including physical or psychological harm exacerbated by hardware use; device malfunctions, overheating, battery issues, or connectivity failures; and incompatibility leading to degraded performance or inability to use certain features. Any use of third-party hardware is at your own risk.

9Privacy and Data Protection

The App's AR Menu feature requires access to your device's camera to scan designated QR cards to identify and load the corresponding 3D cultural model, and to provide real-time augmented reality overlay by processing the live camera feed on your device.

The live camera feed is not recorded, stored, or transmitted to us unless explicitly required for technical support with your consent. No biometric data — including facial recognition or eye-tracking — is inferred or collected.

By enabling camera access and using the AR feature, you consent to this limited, on-device processing solely to deliver the educational AR experience. You may revoke camera permission at any time via your device settings, though this will disable the AR Menu.

Your personal data is processed in accordance with the DPDP Act, 2023 and applicable laws. For full details on collection, use, storage, your rights, security measures, and grievance redressal, please refer to our Privacy Policy.

10Termination and Suspension

10.1 Suspension or Termination by the Company

We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or permanently terminate your access to the App at any time for any reason, including any actual or suspected violation of these Terms, our Privacy Policy, or applicable laws; conduct that poses a security risk or threat to the App's integrity; legal requirements, court orders, or government directives; or fraud, misuse, or unauthorized access.

Suspension or termination may be temporary or permanent and may occur without liability to you. Upon suspension or termination, your right to access and use the App ends immediately.

10.2 User-Initiated Cessation and Account Deletion

You may cease using the App at any time by uninstalling it from your devices. If you have created an account or provided personal data, you may request deletion in accordance with the DPDP Act, 2023 by contacting our Grievance Officer (Clause 15). Upon successful deletion, you will no longer have access to your account or any associated content or features.

10.3 Effect of Termination

Upon any termination or suspension, your license to access and use the App and Services shall immediately cease. Provisions that by their nature should survive termination (including Intellectual Property Rights, Limitation of Liability, Indemnification, and Governing Law) shall continue in full force and effect.

11Disclaimers and Limitation of Liability

11.1 No Warranty

The Company and its affiliates make no representation or warranty about the App or Services, including any representation that the App or Services will be uninterrupted or error-free. The App and Services are provided on an "as is" and "as available" basis.

To the fullest extent permitted under applicable law, the Company and its affiliates disclaim any implied or statutory warranty, including any implied warranty of title, accuracy of data, non-infringement, merchantability, or fitness for a particular purpose. Your use of the App is at your own risk.

11.2 Exclusion of Liability

To the fullest extent permitted by law, the Company will not be liable in connection with these Terms for:

• Lost profits or lost business opportunities, reputation, loss of data, or any indirect, incidental, consequential, special, or punitive damages
• Damages arising from XR-Related Risks (as defined in Clause 5), device incompatibility, or third-party hardware issues

12Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, agents, licensors, partners, and successors from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• (a) Your breach or violation of these Terms, the Privacy Policy, or any other incorporated policies
• (b) Your misuse of the App, the Services, or any content provided therein (including unauthorized use, sharing of access credentials or QR codes, commercial exploitation, or violation of intellectual property rights)
• (c) Any infringement or alleged infringement by you of any third-party rights, including intellectual property rights, privacy rights, or other proprietary rights
• (d) Any content, data, or materials you submit, upload, transmit, or make available through the App
• (e) Your negligence, willful misconduct, fraud, or violation of applicable laws while using the App or Services
• (f) Any attempt by you to introduce, transmit, or facilitate any malicious code, virus, malware, ransomware, or other harmful software that corrupts, damages, or compromises the App, its servers, or the experience of other users

This indemnification obligation shall survive the termination or expiration of these Terms and your access to the App.

13Governing Law, Dispute Resolution and Jurisdiction

These Terms are governed exclusively by the Laws of India. Any dispute arising out of or in connection with these Terms shall first be resolved through arbitration under the Arbitration and Conciliation Act, 1996.

The arbitration shall be conducted by a sole arbitrator mutually appointed by the Parties. If the Parties fail to agree on the appointment within thirty (30) days of a written notice of the existence of a dispute, the arbitration will be referred to an arbitral tribunal of three arbitrators — each Party will appoint one arbitrator, and the two so appointed will jointly appoint the third. The seat of arbitration shall be Chennai, Tamil Nadu, and the language shall be English. The arbitral award shall be final, conclusive, and binding on the Parties.

Subject to the exhaustion of arbitration proceedings, the competent courts in Chennai, Tamil Nadu, India shall have exclusive jurisdiction over any disputes. We encourage amicable resolution — please contact our Grievance Officer (Clause 15) first for any issues.

14Amendments

We may update these Terms at any time. The changes will be posted in-App with an updated date. Your continued use constitutes acceptance of the revised Terms.

15Grievance Redressal Mechanism

16Severability

If any term, condition, or clause of these Terms is held by a court or other competent authority to be invalid, illegal, void, or unenforceable for any reason, such invalidity or unenforceability shall not affect, impair, or invalidate any other term or clause of these Terms. The remaining provisions shall continue in full force and effect and shall be construed as if the invalid portion had never been included.

17Force Majeure

We shall not be liable for any failure or delay in providing the App, Services, or fulfilling any obligations under these Terms to the extent such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, flood, fire, earthquake, epidemic, pandemic, war, terrorism, riots, civil unrest, government orders or restrictions, embargoes, strikes, labour disputes, internet or telecommunication failures, or any other cause not reasonably within our control ("Force Majeure Event").

In the event of a Force Majeure Event, we will take reasonable steps to minimise disruption and resume normal operations as soon as practicable. We will inform users of significant disruptions through in-app notifications or announcements on our official websites.

18Assignment

We may assign, transfer, or subcontract any or all of our rights and obligations under these Terms to any affiliate, successor, or third party without your prior consent.

You may not assign, transfer, or subcontract any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this clause shall be null and void.
